1. Acceptance

By accessing or using Vershun ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

Vershun is a changelog-as-a-service platform that allows you to create, manage, and publish changelog pages for your products. The Service includes a dashboard, public changelog pages, an embeddable widget, email notifications, and an API.

3. Accounts

  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account.
  • You must not use the Service for any illegal or unauthorized purpose.
  • One person or legal entity may not maintain more than one free account.

4. Plans and billing

  • The Service offers free and paid plans as described on our pricing page.
  • Paid plans are billed monthly or annually via Stripe.
  • Prices are in euros (EUR) and exclude applicable taxes.
  • You can upgrade, downgrade, or cancel your plan at any time.
  • Downgrades take effect at the end of the current billing period.
  • No refunds are provided for partial billing periods.
  • We reserve the right to change prices with 30 days notice.

5. Your content

  • You retain ownership of all content you create on the Service (posts, images, settings).
  • You grant us a limited license to host, display, and distribute your content as necessary to provide the Service (e.g., rendering your public changelog page, sending email notifications).
  • You are responsible for ensuring your content does not violate any laws or third-party rights.
  • We do not monitor or review user content, but we reserve the right to remove content that violates these terms.

6. Subscriber data

  • When visitors subscribe to your changelog, you are the data controller for their email addresses.
  • We process subscriber data on your behalf as a data processor.
  • You must ensure you have a valid legal basis for collecting subscriber emails (the double opt-in mechanism helps with this).
  • You must not use the Service to send spam or unsolicited emails.

7. Prohibited uses

You may not use the Service to:

  • Send spam, phishing, or malicious content
  • Host malware or harmful code
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Distribute illegal, abusive, or hateful content
  • Attempt to gain unauthorized access to the Service or other users' data
  • Resell the Service without our written consent

8. Widget and embed

  • The Vershun widget is designed to be embedded on third-party websites.
  • You are responsible for ensuring the widget does not interfere with your website's functionality.
  • The widget makes API calls to vershun.io to fetch changelog data.
  • On the free plan, the widget displays a "Powered by Vershun" watermark.

9. API usage

  • The API is available on paid plans.
  • API usage is subject to rate limits as described in our documentation.
  • You must not use the API to scrape or bulk-download data.
  • API keys and authentication tokens must be kept confidential.

10. Availability

  • We strive to maintain high availability but do not guarantee uptime.
  • We may perform maintenance with reasonable advance notice.
  • We are not liable for downtime caused by factors beyond our control.

11. Termination

  • You can delete your account at any time via the dashboard.
  • We may suspend or terminate accounts that violate these terms.
  • Upon termination, your data is permanently deleted within 30 days.

12. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind.
  • We are not liable for any indirect, incidental, or consequential damages.
  • Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

13. Governing law

These terms are governed by the laws of France. Any disputes shall be submitted to the courts of Paris, France.

14. Changes

We may update these terms. Significant changes will be communicated via email or dashboard notification at least 30 days in advance.
